Terms of Use NAHSHUTTLE 

The purpose of NAHSHUTTLE 

NAH.SH GmbH, Raiffeisenstraße 1, 24103 Kiel, operates a booking platform under the name “NAHSHUTTLE” for a scheduled demand-responsive passenger transport service, a so-called on-demand service. The County of Rendsburg-Eckernförde (Kreis Rendsburg-Eckernförde), the County of Schleswig-Flensburg (Kreis Schleswig-Flensburg), the County of Nordfriesland (Kreis Nordfriesland) and Amt Süderbrarup are partners and shared service providers in this service.  

The partners enable users to search for an individual shuttle service in their area via the on-demand app. The service can be booked via app or telephone and takes passengers to their individual destination at the defined service times. Charges apply for the service. 

The service serves as a demand-responsive mobility concept that complements local public transport and is based on its pricing system, the Schleswig-Holstein tariff.  

The service provider for the technical implementation and provision of the service is ioki GmbH, a subsidiary of Deutsche Bahn. 

The following conditions apply when using the app. 

Technical availability of the app and liability 

The technical implementation of the app is carried out by ioki GmbH. NAH.SH GmbH, the project participants and ioki GmbH do not assume any warranty or assurance for the flawless functioning of the app.  

NAH.SH GmbH reserves the right to change or discontinue the service at any time.  

Liability of NAH.SH GmbH as the provider of this app – regardless of the legal grounds – exists only if damage is caused by culpable breach of a contractual obligation in a manner that jeopardizes the achievement of the contractual purpose or is attributable to intent or gross negligence. The above exclusion of liability shall not apply in the event of culpable injury to life, limb or health and for liability claims under the Product Liability Act. 

NAH.SH GmbH shall not be liable for damages resulting from the impairment of the availability of the app, in the event of technical malfunctions that cannot be influenced and events of force majeure as well as malfunctions caused by third parties. However, NAH.SH GmbH will make every effort to ensure the reliability and functionality of the app.  

Furthermore, NAH.SH GmbH does not guarantee that the app can be installed on the user’s respective end device and that it will function properly. There is no entitlement to use the app. The application is generally available for the Android and iOS operating systems.  

NAH.SH GmbH may reject registrations, exclude already registered users from use and delete their profile without providing justification, in particular if users violate the terms of use. 

Commercial use and automatic services 

Any commercial use of the App is prohibited. The use of automated systems or automated software to extract content from this app is prohibited. Also, any access to the app’s content other than through the NAH.SH app’s user interface is prohibited.  

Registration 

In order to use the services of the on-demand service provided by NAH.SH GmbH, it is first necessary to download the free on-demand app from the Play store for the Android application or from the App store for the iOS application on a mobile device. In addition, registration is required. Registration requires providing a real mobile number as well as the username.  

Registration takes place via two-factor authentication: after registering with their mobile number, users receive a code to this mobile number, which they can use to complete their registration.  

Registered users have the option of setting up a profile. Registered users can also view previously booked trips and the corresponding data in their customer account.  

The accuracy of the app’s content 

NAH.SH GmbH assumes no responsibility for the accuracy, completeness and timeliness of the content provided in the app. The main purpose of the app is to book an individual shuttle service under the indicated terms of use.  

NAH.SH GmbH does not guarantee that the offered journey will take place. Subcontractors commissioned by NAH.SH GmbH as well as the County of Rendsburg-Eckernförde, the County of Schleswig-Flensburg, the County of Nordfriesland and Amt Süderbrarup are responsible for the actual transport, these include Transdev Nord GmbH (service area Rendsburg region), as well as Rohde Verkehrsbetriebe GmbH (service areas Amt Süderbrarup and Amt Mittleres Nordfriesland). 

Tariff conditions pertaining to the Schleswig-Holstein tariff. 

The transport services of the on-demand service booked via the platform are subject to the fare conditions of the Schleswig-Holstein Tariff (SH-Tarif). The current version of the fare conditions can be viewed at https://www.nah.sh/en/tickets/the-schleswig-holstein-tariff/. The transportation conditions of the Schleswig-Holstein local public transportation system also apply. 

Booking of journeys 

Booking a ride with the on-demand service is done exclusively via the app or by telephone.  

Users can submit a non-binding connection request via the app, specifying a desired travel time and a starting point and destination. If users provide their location data, it is automatically included in the request.  

Based on this input, the booking system stored in the app determines a concrete, bookable trip proposal. Users are shown an estimated pickup time, an estimated arrival time, the anticipated duration of the trip, the distance to be covered, the validity of the offer, and a price for the trip calculated on the basis of the Schleswig-Holstein tariff. If the user confirms the trip offer via the booking option, he/she enters into a binding transport contract.  

Booking payment 

When registering, but at the latest when actually booking a ride for the first time, the corresponding payment data must be entered using either SEPA direct debit, credit card or PayPal. Depending on the selected payment method, additional personal information is required.  

In the case of credit card payment, the credit card data must be provided, and in the case of SEPA direct debit payment, the personal account details with an IBAN must be provided. 

Users who do not want to enter this information in the app can use the booking option via telephone or PayPal. Direct payment in the form of cash at the start of the journey is also possible. 

Users are obliged to provide the essential data for the contractual relationship (in particular address and payment method). The payment itself is made via a payment service provider.  

Data Privacy 

Users of the app agree that their personal data (name, telephone number, e-mail address) may be collected, processed and stored electronically for registration in the app. Users may revoke their declaration of consent to NAH.SH GmbH at any time, object to the further use of their data at any time and request that their respective user profile be deleted. The revocation must be sent in writing to:

After receipt of the revocation, the participant’s personal data will no longer be processed or used and will be deleted. In the event of revocation, the user can no longer use the services of the NAHSHUTTLE app.  

In accordance with the statutory provisions, users can obtain information about their stored personal data at any time and request its deletion.
